Welcome to House of African Fashion (HAF)! These Terms and Conditions ("Terms") govern
your access to and use of the House of African Fashion website and online marketplace (the
"Platform"), operated by House of African Fashion (HAF), a company duly registered under the
laws of Zambia, with its principal place of business at plot No. 687/7 off Los-Angeles Rd.
Makeni, Lusaka, Zambia.
By accessing or using the Platform, you agree to be bound by these Terms, our Privacy Policy,
and any other policies or guidelines referenced herein. If you do not agree to these Terms, you
may not access or use the Platform.
1. Introduction and Acceptance of Terms
1.1. Purpose: The HAF Platform is an online marketplace connecting customers with
independent vendors ("Vendors") selling authentic African fashion, arts, crafts, and indigenous food products.
1.2. Agreement: These Terms constitute a legally binding agreement between you and HAF. By creating an account, making a purchase, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.3. Changes to Terms: HAF reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
2. User Accounts
2.1. Account Creation: To access certain features of the Platform, you may need to create a customer account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2. Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify HAF immediately of any unauthorized use of your account or any other breach of security. HAF will not be liable for any loss or damage arising from your failure to comply with this security obligation.
2.3. Eligibility: You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account and make purchases on the Platform.
3. Product Information and Pricing
3.1. Product Descriptions: HAF strives to ensure that product quality, images, and other information provided by Vendors on the Platform are accurate and complete. However, HAF does not warrant that product quality or other content on the Platform are entirely accurate, complete, reliable, current, or error-free. Products may vary slightly from their images due to variations in display settings or the handmade nature of certain items. However, HAF will build on the product description provided by the vendor with information gathered through the Information gathering Initiative that is scheduled to be implemented countrywide.
3.2. Pricing: All prices are listed in Zambian Kwacha (ZMW)as indicated on the Platform. Prices are subject to change by the Vendors without prior notice. HAF is not responsible for pricing errors made by Vendors. Please note that the listed price does not include delivery price.
3.3. Availability: Product availability is subject to the Vendor's inventory. While HAF endeavors to reflect accurate stock levels, we cannot guarantee that all products listed will always be in stock.
4. Ordering and Payment
4.1. Order Placement: When you place an order through the Platform, you are making an offer to purchase the product(s) from the respective Vendor. All orders are subject to acceptance by the Vendor and confirmation by HAF.
4.2. Payment: HAF facilitates payment processing on behalf of Vendors. You agree to pay all charges incurred by you or on your behalf through the Platform, at the prices in effect when such charges are incurred. You authorize HAF to charge your chosen payment method for any such purchases.
4.3. Payment Security: HAF utilizes secure payment gateways to protect your financial
information. However, no online transaction is entirely risk-free, and HAF cannot guarantee the absolute security of your payment data
5. Shipping and Delivery
5.1. Shipping Costs: Shipping costs will be calculated and displayed to you before check out. These costs may vary based on product size, weight, destination, and the Vendor's location and your location.
5.2. Delivery Times: Estimated delivery times are provided for your convenience but are not guaranteed. Actual delivery times may vary due to factors beyond HAF's control, including customs delays, logistics issues, and local delivery conditions.
5.3. Customs and Duties: For international orders, you may be subject to import duties, taxes, and customs fees levied by the destination country. These charges are the sole responsibility of the customer and are not included in the product price or shipping cost. HAF is not responsible for any delays caused by customs clearance procedures.
5.4. Risk of Loss: The risk of loss and title for products purchased from the Platform pass to you upon the Vendor's delivery of the products to the courier in perfect condition.
6. Returns and Refunds
6.1. Return Policy: HAF operates a customer-friendly return and refund policy. Details of this policy, including eligibility criteria, return windows, and procedures, are available on the "Returns & Refunds Policy" page of the Platform.
6.2. Vendor Responsibility: While HAF facilitates the return process, the ultimate responsibility for product quality, accuracy, and adherence to the return policy rests with the individual Vendor.
6.3. Defective/Damaged Products: If you receive a defective or damaged product, please contact HAF customer service immediately, providing photographic evidence. We will work with the Vendor to resolve the issue in accordance with our return policy.
7. Intellectual Property
7.1. Platform Content: All content on the HAF Platform, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of HAF or its content suppliers and protected by international copyright, trademark, and other intellectual property laws.
7.2. Vendor Products: The intellectual property rights in the products sold on the Platform belong to the respective Vendors. HAF is granted a license to display these products for sale on the Platform.
7.3. Limited License: HAF grants you a limited, non-exclusive, non-transferable,
non-sublicensable license to access and make personal and non-commercial use of the
Platform. This license does not include any resale or commercial use of the Platform or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Platform or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.
8. User Conduct
8.1. Prohibited Activities: You agree not to: * Use the Platform for any unlawful purpose or in any way that violates these Terms. * Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity. * Interfere with or disrupt the operation of the Platform or the servers or networks connected to the Platform. * Engage in any fraudulent activity, including but not limited to making false claims or misrepresentations. *
Upload or transmit any content that is harmful, offensive, defamatory, or infringes on the rights of others.
8.2. Reviews and Feedback: You may submit reviews, comments, and other content, provided that the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable. HAF reserves the right (but not the obligation) to remove or edit such content.
9. Disclaimers and Limitation of Liability
9.1. "As Is" Basis: The HAF Platform and all information, content, materials, products, and services included on or otherwise made available to you through the Platform are provided by HAF on an "as is" and "as available" basis, unless otherwise specified in writing.
9.2. No Warranties: HAF makes no representations or warranties of any kind, express or
implied, as to the operation of the Platform or the information, content, materials, products, or services included on or otherwise made available to you through the Platform. You expressly agree that your use of the Platform is at your sole risk.
9.3. Vendor Responsibility: HAF is a marketplace. We do not manufacture, store, or directly ship the products. Therefore, HAF explicitly disclaims all liability for any product defects, safety issues, misrepresentations, or non-compliance with standards related to products sold by Vendors on the Platform. All such liabilities rest solely with the respective Vendor.
9.4. Limitation of Liability: To the fullest extent permitted by applicable law, HAF will not be liable for any damages of any kind arising from the use of the Platform or from any information, content, materials, products, or services included on or otherwise made available to you through the Platform, including, but not limited to direct, indirect, incidental, punitive, and consequential
damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless HAF, its affiliates, officers, directors,
employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
● Your access to or use of the Platform.
● Your violation of these Terms.
● Your violation of any rights of a third party, including intellectual property rights.
● Your purchase or use of any products from the Platform.
11. Governing Law and Dispute Resolution
11.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law principles.
11.2. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved amicably through good faith discussions. If an amicable resolution cannot be reached within [e.g., thirty (30) days], the dispute shall be submitted to the exclusive jurisdiction of the courts of Zambia
12. Miscellaneous
12.1. Severability: If any provision of these Terms is found to be unlawful, void, or for any
reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.
12.2. Waiver: No waiver of any provision of these Terms by HAF shall be deemed a further or continuing waiver of such provision or any other provision, and HAF's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
